MARA Code of Conduct

The Code of Conduct for Registered Migration Agents is set out in legislation to regulate the conduct of Registered Migration Agents. It prescribes Registered Migration Agents' obligations towards clients.

Provision for a Code of Conduct for Migration Agents is set out in Section 314 of the Migration Act 1958 and is prescribed in Schedule 2, Regulation 8 of the Migration Agents Regulations 1998.

Under Australian law, a person who wishes to operate as a migration agent must be registered with the Office of Migration Agents Registration Authority (“OMARA”).

The Code of Conduct is intended to regulate the conduct of Migration Agents. Amongst the requirements of the Code, is the ability of Agents to demonstrate good character as well as competency in the provision of Australian immigration advice and protect the consumers and community.

Under the Code of Conduct, Registered Migration Agents have a range of obligations covering:

  • Interactions with your clients
  • Fees and charges, record keeping and financial management
  • Responsibilities toward other Registered Migration Agents
  • Any employees hired
  • The requirement that Registered Migration Agents respond if a complaint is made against Registered Migration Agents 
  • Another obligation is to prominently display the Code of Conduct in the office and client waiting area.
  • Registered Migration Agents must also provide clients with a copy of it to keep if they ask for one.
